Mira Flores UPDATE: Foreclosures delayed but still moving forward | Mira Flores ACTUALIZACIÓN: Ejecuciones hipotecarias retrasadas pero siguen avanzando

This month Councilwoman Robinson continued to check in with the City Attorney’s office who is actively tracking and regularly communicating with lenders who have filed for foreclosure on the Mira Flores property. In June 2023 both trust deeds rescheduled the foreclosure and auction to July 6th, 2023. According to the City Attorney’s office the lenders can reschedule the foreclosure and auction indefinitely.

CM Robinson has inquired as to possible pathways forward including but not limited finding a developer who would be willing to purchase the property so the project can move foward. The City Attorney’s office let us know that while the property is in this limbo the lenders in foreclosure CANNOT enter into an agreement prior to the foreclosure to sell the property to a third party. They say that this is called “chilling the bidding” as that third party should be bidding at the foreclosure sale.

The ball is truly in the court of the lender and of course the current developer who continues to assert they are in the process of securing funding although we would love for this to be true, the City has yet to see proof of this claim.

CM Robinson and City staff will continue to look for ways to help move this project forward and will continue to stay in touch with the current developer and the lenders throughout the foreclosure process and auction.

Este mes, la concejal Robinson siguió comunicándose con la oficina del fiscal de la ciudad, que está haciendo un seguimiento activo y comunicándose regularmente con los prestamistas que han presentado una solicitud de ejecución hipotecaria sobre la propiedad de Mira Flores. En junio de 2023, ambas escrituras fiduciarias reprogramaron la ejecución hipotecaria y la subasta hasta el 6 de julio de 2023. Según la oficina del fiscal de la ciudad, los prestamistas pueden reprogramar la ejecución hipotecaria y la subasta de manera indefinida.

La concejal Robinson ha preguntado sobre posibles vías a seguir, que incluyen, entre otras, encontrar un desarrollador que esté dispuesto a comprar la propiedad para que el proyecto pueda seguir adelante. La oficina del fiscal de la ciudad nos informó que mientras la propiedad esté en este limbo, los prestamistas en ejecución hipotecaria NO PUEDEN celebrar un acuerdo antes de la ejecución hipotecaria para vender la propiedad a un tercero. Dicen que esto se llama “enfriar la licitación”, ya que ese tercero debería ofertar en la venta de ejecución hipotecaria.

La pelota está realmente en la cancha del prestamista y, por supuesto, del desarrollador actual, que sigue afirmando que está en el proceso de conseguir financiación, aunque nos encantaría que esto fuera cierto, la ciudad aún no ha visto pruebas de esta afirmación.

CM Robinson y el personal de la ciudad seguirán buscando formas de ayudar a que este proyecto avance y seguirán en contacto con el desarrollador actual y los prestamistas durante todo el proceso de ejecución hipotecaria y la subasta.
